Common questions after an injury
Can I still recover if I was partly at fault?
Often, yes. Arizona uses pure comparative fault (A.R.S. § 12-2505). If you share some of the blame, your recovery is generally reduced by your percentage of fault instead of being barred. There are exceptions. For example, under A.R.S. § 12-711, a person who was under the influence of alcohol or drugs and was 50% or more at fault may be barred from recovering, and different rules can apply to intentional conduct. What if the other driver had no insurance or not enough insurance?
You may be able to make a claim under the uninsured motorist (UM) or underinsured motorist (UIM) coverage on your own policy, if you have it. Your policy may require you to cooperate with your own insurance company, but call us before you give a recorded statement to any insurer, including your own. We can look at your policy with you and explain your options.
How long do I have to file a claim in Arizona?
Many Arizona injury lawsuits must be filed within two years (A.R.S. § 12-542). Claims against a city, county, the state, another public entity or a public employee are much shorter: a written notice of claim is generally due within 180 days (A.R.S. § 12-821.01), and the lawsuit generally must be filed within one year (A.R.S. § 12-821). Different rules can apply to minors, wrongful death claims and dog bites. For example, a strict-liability dog-bite claim has a one-year period (A.R.S. § 12-541). Deadlines depend on your facts, so call us early.
